I just remembered the man that died in PIA A310 landing gear box at Jeddah to Karachi flight before few monthes.
According to some aviation sites which has direct relation with Saudi aviation said that " A saudi airline pilot who was taxing behind that PIA plane saw some one on the landing gear of PIA and informed JED ATC about that. After PIA tookoff the ATC asked the PIA pilot to come back to airport but the pilot refused and he just made the gear down and up and continued his journy to KHI.
I like to know is there are any restrection on the pilot as ATC ordered him to return back but the pilot refused ???
In this cases How far the pilot has to obey ATC??

i assume that ATC may be disobeyed if they is a danger to the aircraft i.e from striking another aircraft etc - esp if they are in the same air corridor - such as the A320 of airBlur and A310 of PIA.
In general the pilot is in command and has a better understanding of the situation around him/her as he/she is flying, so i assume they can take evasive action if needed.

The ATC is always in an advisory capacity the final responsibilty including traffic avoidance and terrain clearence rests with the PIC. ATC can always pass adivisories, however the reason for non compliance is to be given by the pilot especially if it involves other air traffic conflicts.
In view of the landing gear stowaway, the story needs to be checked since had explicit instructons been passed by the ATC to the pilot, then beyond any shadow of doubt the pilot would have landed back.
In such situations no pilot in his right mind would continue to his destination knowing fully the devastating consequences.
