PIA, CAA given till 29th to file comments in plane crash case

KARACHI: The Sindh High Court on Wednesday directed the chairman of the Pakistan International Airlines and the Civil Aviation Authority to file comments by Nov 29 in a petition about various incidents of ATR plane crashes.
The two-judge bench headed by Justice Mohammad Ali Mazhar said that the counsel for the CAA again sought time to file a reply, adding that the matter had been pending since 2016 and as a last chance two weeks’ time was being granted.
The bench also issued a notice to the PIA chairman with the directions to ensure that the comments of the national flag carrier must be submitted and its representative must appear before the court at next hearing.
Putting off the matter till Nov 29, the court said that a copy of the order be transmitted to the PIA chairman and the CAA director general for strict compliance.

He said the CAA director general had written to his seniors making startling disclosures about the functioning of ATR planes.
The petitioner said that 20 incidents were recorded in which the engines of ATR planes used by the national flag carrier had stopped during flights. Besides, 90 cases of ATR planes’ removal of engines were recorded as well, he added.
He said that despite having knowledge of the defects in the aircraft, the respondents did not take precautionary measures to avoid accidents and save previous lives.
He argued that after the occurrence of such incidents in the past, it was the constitutional obligation of the cabinet division secretary, the CAA DG and the PIA chairman to refrain from purchasing outdated planes, using them and risking the lives of the passengers and crew members.
Kazmi claimed that the respondents had violated Article 9 of the Constitution as well as the civil aviation rules. He pleaded for a judicial inquiry into the crash to fix responsibility on the relevant officials and prosecute them, and for ordering compensation to the legal heirs of the victims.
He requested the SHC to direct the respondents to ground all the planes currently being used by the PIA and to order their inspection by the CAA or any other independent investigating agency or department. The counsel for the CAA once again requested further time to respond.
A division bench headed by Justice Mohammad Ali Mazhar observed that the matter had been pending since the past three years, and so he gave a last chance to the CAA to file comments on the petition by November 29.
The court also issued a notice to the PIA chairman to ensure that their comments would be filed and a representative of the national flag carrier would appear before the bench in the next hearing.

KARACHI: The Sindh High Court on Thursday put the secretary of the aviation department on notice and called a progress report about a pending inquiry into an ATR aircraft crash in 2016.
The two-judge bench headed by Justice Mohammad Ali Mazhar also directed the Civil Aviation Authority (CAA) to file a report regarding the number of operational ATRs, details about grounded ATRs, issuance of airworthiness certificates and whether proper procedures were followed before issuing such certificates.
When a petition about various incidents of ATR plane crashes came up for hearing on Thursday, the additional director of the airworthiness department of the CAA, Amir Hasan, filed a reply.
However, the bench observed that it had specifically directed the CAA to inform the court about how many ATRs were operational with aircraft aging, number of grounded ATRs, when the airworthiness certificates were lastly issued and whether proper procedure had been followed before issuing such certificates by the CAA.
It directed the additional director to personally submit answers to these questions by Jan 21.
A woman turned up during the hearing and told the bench that she had come to know about the pendency of this petition and appeared to witness the proceedings since she said her son, Ahmed Mansoor Janjua, first officer, was also in the ATR that crashed in December 2016.
She further submitted that despite various approaches neither the CAA nor the Pakistan International Airlines (PIA) informed her about the fate of an inquiry into the ATR crash.
The CAA official contended that an inquiry was being conducted by the aircraft accident investigation and inquiry board at the federal capital under the aviation division.
He maintained that the outcome of the ongoing inquiry was not known to the CAA or the PIA.
Therefore, the bench issued a notice to the aviation department secretary with the direction to depute an officer concerned to appear in court on Jan 21 with a progress report, if any, with regard to a pending inquiry.
It said the notice be served through the district judge of Islamabad and courier service while assistant attorney general was also directed to inform the aviation secretary to ensure the presence of a representative at the next hearing. Copies of the replies submitted by the CAA and PIA be provided to the petitioner, it was observed.
The petition was filed after an Islamabad-bound flight of the national flag carrier had crashed near Abbottabad after it took off from Chitral on Dec 7, 2016 in which 42 passengers and crew, including singer-turned preacher Junaid Jamshed and his wife, lost their lives.

The court directed the officer of CAA to submit queries of the court with regard to the ATR operations before the court on January 21.

ISLAMABAD, Dec 13 (APP): Federal Minister for Aviation Division Ghulam Sarwar Khan on Friday informed the Parliament that the interim report of Pk-661 Havelian crash will be presented in the House in next week.
Pakistan International Airlines (PIA) Flight PK-661 a domestic passenger flight from Chitral to Islamabad, was crashed near Havelian on December 7, 2016.
All 47 people on board died, including singer-turned-preacher and entrepreneur Junaid Jamshed and the Deputy Commissioner of the District of Chitral.
An initial report into the accident by the Pakistan Civil Aviation Authority (PCAA) said that the aircraft’s left engine malfunctioned at an altitude of 13,375 feet (4,077 m).
The pilot reported the engine failure at 16:12, which was followed by a rapid uncontrolled descent and the disappearance of the aircraft from ground radar a few minutes later.
A one-page preliminary report of the Safety Investigation Board found a ‘lapse’ on the part of the PIA and a ‘lack of oversight’ by the PCAA.
Answering to the question of luggage handling, the minister responded that the daily report of the time consumed is maintained for domestic and international flights.
Standard time of one hour has been bench marked for baggage delivery at the belt which generally commences after 15 minutes of aircraft engine shutdown.
He informed the House that annually 457 flights operated from Karachi’s Jinnah terminal and no complaint of delay in the luggage uploading or offloading was registered.
Similarly, annually 289 flights operated from Lahore’s Allama Iqbal International Airport and no compliant was received however annually 348 flights were operated form Islamabad International Airport out of which 24 flights were reported to delay the luggage delivery and the matter is under investigation, said the minster.
He said the provision of requisite ground handling staff and unit load device is solely the responsibility of the concerned airline, adding Airlines through their own staff or by ground handling agencies manage the same.

Its the fault of PIA engineering and if the report is published it will make passengers sue PIA in court for damages, something the airline and the government does not want.

It's interesting that you write "airlines/investigation bodies" as if those are closely linked and share the same interests (of not paying damages and steering clear of legal proceedings). That may be so in pakistan where the government, the caa, the military, the national airline and the investigators are basically one and the same. In most advanced economies on the other hand, the investigative board is independent of airlines and regulators and sees improvements in aviation safety as its prime interest. That is also the reason they publish their findings: so everyone can avoid past mistakes, even those made by someone else. Interference in an investigation or withholding the results thereof would cause public outrage, resulting in political and legal challenges for airlines and governments alike.

Only six ATR aircraft out of 12 are functional, PIA tells SHC
Only six out the total 12 ATR aircrafts of the Pakistan International Airlines are functional, while rest of the half are grounded due to non-airworthiness, a PIA counsel told the Sindh High Court on Tuesday.
Hearing a petition seeking judicial inquiry into the December 2016 flight PK-661 crash inquiry in which 42 passengers, including singer-turned-preacher Junaid Jamshed and his wife and crew members, had lost their lives, a division bench headed by Justice Mohammad Ali Mazhar took exception over non-filing of reply by the civil aviation authority with regard to the maximum age of an ATR with flying hours.
In a report submitted to the court, the lawyer submitted that out of the total 12 ATR aircrafts, seven were ATR-42-500 and five ATR-72-500.
Breaking it down, the counsel of the PIA said three of the seven ATR-42-500 were operational while the rest of the aircrafts were grounded due to lack of spheres, structural issues, and runway excursion. Similarly, he said three aircrafts of five ATR-72-500 were operational while two were grounded due to collision incident and prolonged grounding.
He also submitted details of the ATRs, including their manufacturing date, date of induction in the PIA fleet and total hours of running. The court however observed that neither did the PIA provide the maximum number of flying hours nor had it mentioned its criterion to discard the aircraft from the fleet. The court observed that the PIT had not told it about the exact discarding age of the aircraft from the fleet in the report.
The SHC observed that the joint director airworthiness and the law officer of the Pakistan Civil Aviation Authority (CAA) had appeared before the court but they failed to file any reply. The court observed that the CAA officials did not response about the court query about the maximum age of ATR with flying hours.
The court issued notice to the CAA director airworthiness to appear in person for assistance of the court.
The SCH also took exception over non-appearance of a CAA official who was dealing with regard to the PK-661 crash inquiry. The court observed that the secretary aviation was directed to depute their relevant officer to attend the court proceedings along with the progress report of the pending inquiry but no officer from the federal law office or the CAA appeared before the court to appraise it about the latest position.
The court issued show cause notice to the secretary aviation to reply as why compliance of the court order was not made in letter and spirit and submit his reply on February 18.

Kazmi claimed that the respondents had violated Article 9 of the Constitution as well as the civil aviation rules. He pleaded for a judicial inquiry into the crash to fix responsibility on the relevant officials and prosecute them, and for ordering compensation to the legal heirs of the victims.
He requested the SHC to direct the respondents to ground all the planes currently being used by the PIA and to order their inspection by the CAA or any other independent investigating agency or department.

Only six out the total 12 ATR aircrafts of the Pakistan International Airlines are functional, while rest of the half are grounded due to non-airworthiness, a PIA counsel told the Sindh High Court on Tuesday.
Hearing a petition seeking judicial inquiry into the December 2016 flight PK-661 crash inquiry in which 42 passengers, including singer-turned-preacher Junaid Jamshed and his wife and crew members, had lost their lives, a division bench headed by Justice Mohammad Ali Mazhar took exception over non-filing of reply by the civil aviation authority with regard to the maximum age of an ATR with flying hours.
In a report submitted to the court, the lawyer submitted that out of the total 12 ATR aircrafts, seven were ATR-42-500 and five ATR-72-500.
Breaking it down, the counsel of the PIA said three of the seven ATR-42-500 were operational while the rest of the aircrafts were grounded due to lack of spheres, structural issues, and runway excursion. Similarly, he said three aircrafts of five ATR-72-500 were operational while two were grounded due to collision incident and prolonged grounding.
He also submitted details of the ATRs, including their manufacturing date, date of induction in the PIA fleet and total hours of running. The court however observed that neither did the PIA provide the maximum number of flying hours nor had it mentioned its criterion to discard the aircraft from the fleet. The court observed that the PIT had not told it about the exact discarding age of the aircraft from the fleet in the report.
The SHC observed that the joint director airworthiness and the law officer of the Pakistan Civil Aviation Authority (CAA) had appeared before the court but they failed to file any reply. The court observed that the CAA officials did not response about the court query about the maximum age of ATR with flying hours.
The court issued notice to the CAA director airworthiness to appear in person for assistance of the court.
The SCH also took exception over non-appearance of a CAA official who was dealing with regard to the PK-661 crash inquiry. The court observed that the secretary aviation was directed to depute their relevant officer to attend the court proceedings along with the progress report of the pending inquiry but no officer from the federal law office or the CAA appeared before the court to appraise it about the latest position.
The court issued show cause notice to the secretary aviation to reply as why compliance of the court order was not made in letter and spirit and submit his reply on February 18.

The federal law officer submitted that the inquiry was in process and sought time to file a complete report as well as a reply of the CAA secretary a show-cause notice. The high court directed CAA to file inquiry report with regard to plane crash and adjourned the hearing till March 17.

According to PIA spokesperson, completed crash investigation report of airline's flight PK661 is with the Aviation Division.
Government can answer better why the completed report has not been published/released, the spokesperson said.

December 7, 2016, PIA ATR 42-500 (AP-BHO) completed accident report will be presented in the parliament and released to public, said Aviation Minister Ghulam Sarwar Khan at a press conference today.
