By the way relevant to the topic, this may be an interesting article; as PIA needs a "Superman" (which maybe a retired or serving judge only) as directed by the supreme & honourable court(s)...

Supreme Court hearing the case today. Discussion in the court included:
  • CEO PIA appointment procedure/advertisement.
  • Reports submitted to the court by the government and PIA about achievements made by Air Marshal Arshad Malik.
The court was informed that Air Marshal Malik was selected from short-listed candidates. Only five officers from PAF came to PIA. Air Marshal Malik has vast experience in the field of aviation, the court was informed.

PIA Board of Directors (BoD) meeting on February 11 was chaired by board member Tariq Kirmani. The meeting was attended by all board members.

Air Marshal Arshad Malik stopped by the court from working as CEO PIA was not present at the meeting.

PIA CEO being paid Rs959,468, SC told

ISLAMABAD: Defending the appointment of Air Marshal Arshad Malik as Chief Executive Officer (CEO) of Pakistan International Airlines Corporation (PIAC), the company’s board has told the Supreme Court that, “owing to chronic mismanagement contributing to colossal losses running into billions, it was deemed appropriate and necessary that personnel from the armed forces, especially the Air Force, be given the opportunity to apply for the position of PIAC CEO”.

PIAC’s Board has also submitted a concise statement through its counsel, Salman Akram Raja, in the apex court regarding the alleged illegal appointment of the PIA CEO. The statement shares complete details of eight Pakistan Air Force (PAF) officers who are working on deputation in the department.

The statement says that the PIA CEO was being paid Rs959,468 in gross salary; Air Commodore Aamer Altaf, the Chief Human Resources (HR) Officer, was being paid Rs639,778; Air Commodore Khalid Barlas, the Chief Information Officer, Rs596,464; Air Commodore Jibran Saleem Butt, the Sky Rooms Ltd CEO, Rs561,574; Air Commodore Jawad Zafar, the Chief Corporate Development Officer, Rs595,414; Air Commodore Shahid Qadir, the Head of Security, Rs537,154; Wing Commander Muhammad Asim, the General Manager, Accounting, Rs446, 229; and Wing Commander Kamran Anjum, the Speed Ex Courier General Manager, was being paid Rs374,770.

SC questions grounds of PIA CEO’s appointment

The Supreme Court of Pakistan Wednesday asked how a person who joined Pakistan International Airline (PIA) on deputation could be appointed its chief executive officer (CEO).

A three-member bench of the apex court headed by Chief Justice Gulzar Ahmed conducted hearing of Air Marshal Arshad Mehmmod Malik appeal against the Sindh High Court order restraining him from performing functions as CEO of PIA.

During the hearing, Justice Sajjad Ali Shah asked how a person, who has joined PIA on deputation, could be appointed its CEO. Salman Akram Raja, representing PIA Board of Directors said there are many judgments of Supreme Court on the issue.

He informed that Arshad Malik would retire from PAF in 2022, adding till that time he would not receive perks and privileges from the PAF.

The bench directed Salman Raja to assist the court regarding the matter.

Earlier, the Chief Justice of Pakistan Justice Gulzar Ahmad said the reports of PIA and the government regarding the appointment of Arshad Mehmood Malik have been examined and it appears that one person has drafted both the reports. “There is only cut and paste.” Air Marshal is highly praised in the reports.

If the Air Marshal is found not fit for the post then he will have to go: CJP

Naeem Bukhari, representing the incumbent CEO, said that on the last hearing the court had observed that many Vice-Marshals and Commodores were brought from PAF, while the fact is that not many, but a few officers came with Air Marshal in PIA. “Whether I (Mr Arshad) am fit for the post or not this has to be decided by the court,” said Naeem.

Justice Ijazul Ahsan said it was interim arrangement but the Air Marshal continually occupying the post. Naeem told that Arshad Malik was appointed in view of the advertisement.

Justice Ijaz questioned whether the post was advertised internationally. He said that in the Supreme Court judgment steps have been mentioned that how the CEO is being appointed.

Justice Sajjad stated that persons had applied for the post of CEO PIA, but the authorities said that one does not have the experience, while the other does not have relevant qualification, thus selected Air Marshal.

The Chief Justice said if the Air Marshal is found not to be fit for the post then he would have to go. Justice Ijaz noted that national carrier had made progress during the time of Air Marshal Asghar Khan and Air Marshal Noor Khan, adding the foreigner CEO took PIA plane to Germany.

Salman Akram Raja said NAB is investigating the matter. The chief justice said the PIA should have filed a criminal case in the German’s court. He questioned how the PIA plane was taken out of the country and no step was taken to bring it back.

Later, the bench adjourned hearing till February 20 in this matter for further proceedings.

On the last hearing the apex court had allowed Pakistan International Airline (PIA) Board to run the affairs of national flag carrier and also the functions of its Chief Executive Officer (CEO)/Chairman.

The bench had turned down Air Marshal Arshad Malik’s prayer to suspend the Sindh High Court (SHC) order restraining him from performing duties. The bench summoned High Court record regarding the matter.

The SHC on 23-12-2019 had restrained Air Marshal Arshad Malik from carrying out any function as the CEO PIA till January 22.

Air Marshal Arshad Malik was a nominated Director PIA since October 17, 2018. He was elected as acting CEO on October 26, 2018 and was appointed regular CEO w.e.f. April 26, 2019 as per PSC Guidelines 2015.

Before joining PIA, Air Marshal Malik was Vice Chief of the Air Staff (VCAS), of Pakistan Air Force (PAF).

In his petition, Malik stated that negotiation for export of planes were conducted by him with Sri Lanka, Myanmar, Egypt, Argentine, Nigeria with orders obtained from them later.

Arshad Malik also stated that he was posted as Deputy Chief of Air Staff (Personnel) for a year, dealing with human resources issues, both of civilians and serving Air Force employees. This assignment included HR Planning, Career Profession Development of the entire Human Resources of the PAF, all over Pakistan.

Malik told that till deputed to PIA he was the Vice Chief of PAF looking after the PAF budget, flight safety, training institutes and media affairs.

Safdar Anjum, had challenged Arshad Malik’s appointment in the SHC. It is his stance that the Air Marshal Malik was a senior serving officer of the Pakistan Air Force (PAF) and his appointment as the PIA chief was made in utter disregard of law laid down by the apex court in its Aug 3, 2018 judgement against the appointment of the then CEO.

Govt defends Arshad’s appointment as PIA chief

The federal government has told the Supreme Court that the appointment of Air Marshal Arshad Malik as chief executive officer (CEO) of the Pakistan International Airlines (PIA) Corporation was challenged before the Sindh High Court because he took strict measures against unlawful actions of the union as well as staff of the national flag carrier.

In a statement before the Supreme Court, Additional Attorney General Khurram Saeed on behalf of the federal government explained that during the tenure of Mr Malik as the PIAC’s CEO the financial performance of the corporation was improved since its operating loss was reduced by 75 per cent and revenue increased by 44pc.

A three-judge Supreme Court bench headed by Chief Justice Gulzar Ahmed is seized with an appeal moved by Air Marshal Malik against the SHC’s order which had restrained him from carrying out any function as the head of the corporation.

The petitioner before the high court had contended that Mr Malik was a senior serving officer of the Pakistan Air Force (PAF) and his appointment as the PIA chief was made in utter disregard of the apex court’s Aug 3, 2018 judgement against the appointment of the then CEO.

The federal government’s report highlighted that the petition before the high court was moved with mala fide intentions, adding that the state of PIA at the time of Mr Malik’s appointment as acting CEO was pathetic and that it had almost collapsed.

The report recalled that after departure of retired air marshals Nur Khan and Asghar Khan, PIA was on a downward curve having losses worth billions of rupees. Its assets were reduced, whereas the corporation was facing serious disciplinary issues, besides its unions had taken over the management indirectly. Its aircraft though capable of flying were grounded and equipment that could have been repaired and used was not being taken care of.

The report recalled that due to alleged unruly and violent behaviour of different individuals in the union, the federal government had to come and support PIA on multiple occasions through financial aids.

The government was of the view that the national flag carrier should be pulled up for which it was necessary that the corporation should be governed in such a manner that strict discipline could be created, aircraft maintenance be improved, non-functional equipment, including aircraft and ground support equipment, be restored and that the assets of PIA be secured indigenously, using local resources.

It was also felt that PIA should be gradually brought to a position where it could manage and run its business of transportation efficiently and become as far as possible self-sustaining, indigenous and also become profitable.

In this regard, an advertisement was published where it was deemed appropriate and necessary that personnel from the country’s armed forces be brought as the CEO of the corporation so that it could be able to recover.

While appointing the CEO, the government had noted that during his tenure as the acting CEO, he had moved fast in rectifying multiple issues in the corporation.

Past glory

Soon after taking over, Mr Malik commenced a plan to rectify the corporation in a manner that it could be restored to its past glory. A number of measures were also taken up and from the day one he took over the affairs of the airline.

Referring to allegations that a multi-million contract awarded to a company which was incorporated a few months earlier, the report explained that the said contract was given for the In-flight Enter­tain­ment System (IFE) for the development of the system indigenously in Pakistan.

Such systems can only be bought from certified vendors on a price settled by them and thus the airline was required to pay upfront billion of dollars.

But in the contract in question, the amount to be paid was Rs700 million with a requirement that the vendor will develop the project and obtain certification from the Boeing company at its own cost and that the airline will not make any payment to the vendor until he gets the certification.

Hearing the case today, Chief Justice said the appointment of CEO on deputation is illegal. Air Marshal Arshad Malik will have to choose position in PAF or PIA, says the court.

PIA needs to be managed professionally The appointment of Air Marshal shows non-seriousness of the government, remarked the court. PIA needs permanent head. Seems the government want to run PIA on ad hoc basis.

Lawyer Naeem Bukhari representing Air Marshal Arshad Malik has sought time from the court to consult with his client.

Case hearing adjourned till the first week of March.

March 3, 2020: According to the news sources;

"At the outset of the hearing, the additional attorney of Pakistan requested the court that Attorney General of Pakistan, Khalid Jawed wants to appear in this case before the court.

“Currently the AGP is in London”, he added and pleaded the court to adjourn the hearing.

The court accepting Naeem Bukhari’s reply adjourned the hearing of the case till March 11."

Supreme Court of Pakistan has allowed Air Marshal Arshad Malik to work as CEO PIA for thirty days on temporary basis.

The court has asked Air Marhal Arshad Malik and PIA employees unions representatives to appear in next hearing of the case.

Details of PIA contracts given under the management of Air Marshal Arshad Malik also sought by the apex court.

Next hearing of the case will take place on April 20.
