Re: CEO PIA Told by Sindh High Court to Stop Working
After a long time PIA making some positive progress and once again they came in to ruin everything.
Why judiciary never liked anyone of atleast last five CEO's as appointed by three different governments? It seems nobody working as per law except judiciary.
Comments based on discrimination from the judges also raise questions on their credibility.

Re: CEO PIA Told by Sindh High Court to Stop Working
We live at the extremes. On one hand govts, past and present placed their cronies at lucrative posts either to oblige them for their political support or to have 'apna banda' in place or for (may be in some cases) outright corruption. Then we made very tough rules for such appointments which resulted in courts throwing out a number of appointees even on minor violation of the prescribed rules. AM Malik might be a good person and leader, but has been the victim of this extreme approach. Previous CEO too was shown the door as his selection did not fully satisfy the rules and was ordered to reimburse the salary he had drawn during his employment. Do not know if court will ask the AM too to return his salary!
This would be an unending story. All appointees will undergo such scrutiny and only angels would be left to be selected. In my opinion at such strategic business positions, more than academic qualifications and degrees, acumen, leadership, understanding of the business and above all sincerity is required. Moreover govt should have the right to appoint a suitable person and then be responsible for his/her actions.
Need to sit down, re draft all such rules and procedures for a smooth working in future.
As the say "hathoon se lagai girhan, dantoon se kholnee perhtee hain"

CEO PIA Hands Over Function of the CEO to Airline's Board of Directors
Islamabad - January 22, 2020 - In line with Securities and Exchange Commission of Pakistan (SECP) Rules, Board of Directors of Pakistan International Airlines Corporation Limited (PIACL) through a competitive process recommended the appointment of Air Marshal Arshad Malik as Chief Executive Officer (CEO) PIACL, which was formally approved by the Federal Cabinet.
Under the leadership of Air Marshal Arshad Malik, a team of dedicated serving PAF officers was tasked to bring organizational discipline in the national flag carrier, restructure and recover it from operational losses and run it along professional lines in order to regain its position in the global aviation industry. With this vision, the team performed its duties to the best of its ability and took professional decisions purely based on merit.
However on the observations of the honorable Supreme Court of Pakistan, CEO PIACL has handed over the function of the CEO of the airline to the board of directors of PIACL.

Re: CEO PIA Told by Sindh High Court to Stop Working
According to news sources:
Auditor General's report has recommended immediate removal of Air Marshal Arshad Malik as CEO PIA. According to auditor's report, the appointment is illegal. All allowances and benefits given to him should be withdrawn/recovered.
The reports seeks independent investigation into illegal appointment. Aviation Division should also determine individual(s) responsible for the illegal appointment, says the report. The appointment was made on the basis of dishonesty, personal liking and in violation of rules/regulations, according to the report.
In the past, PIA Board of Directors also made mistake in the appointment of a foreigner as airline's CEO, says the report.

According to PIA spokesperson:
The airline respects Auditor General's report.
Such reports are attempt to influence Supreme Court ruling.
Opinion on the matter cannot be established because it is sub judice before the Supreme Court.
Air Marshal Arshad Malik was nominated as CEO PIA by airline's Board of Directors.
Air Marshal Arshad Malik already has handed over CEO PIA powers to airline's Board of Directors.

Re: CEO PIA Told by Sindh High Court to Stop Working
The audit report said that Air Marshal Arshad Malik is holding two positions — one of an air marshal in PAF and the other of CEO in the PIA. If properly selected, he would have resigned from PAF to join as CEO in the PIACL, it added.
His appointment as CEO is “based on clear favouritism, mala fide and out of procedure process”. The report held his appointment irregular.
“Further he has managed his appointment by a mix of SECP Rules and Deputation...for Armed Forces officer to keep the benefits of both sides which is a gross violation of relevant rules and transparency.”
It said that “immediate recovery of allowances ... be initiated and the case be referred to independent agency to probe the matter of irregular appointment”.
The aviation division should hold a high-level inquiry to fix responsibility on persons at fault, especially on the board of directors which has committed the very blunder earlier highlighted by the Supreme Court in the case of Mr Cyan, then CEO of PIACL.
The audit report contains 16 paras noting irregular appointments, including that of the CEO; “irregular procurement of services on account of development of indigenous IFE solutions resulted in dubious financial deal worth Rs700 million; operating losses amounting to Rs5,282m; illegitimate elevation in allowances and benefits of officers on deputation from PAF (Rs71.86m); irregular induction of staff with fake degrees (Rs25.68m) and irregular payment due to dual benefits rewarded to CEO (Rs2.995m)”.

Sindh High Court and Supreme court know about Airline business , when did they become experts themselvesAbbas Ali wrote: Tue Jan 21, 2020 11:16 am The Supreme Court rejected on Tuesday Air Marshal Arshad Malik’s appeal to remain the Chief Executive Officer (CEO) of Pakistan International Airlines (PIA) while raising suspicions on increased fares and appointment of ten officers of the Pakistan Air Force (PAF) in the national carrier.
The three-member bench, headed by Chief Justice of Pakistan Gulzar Ahmed, called into question the appointments of four air vice marshals, two air commodores, three wing commanders and one flight lieutenant in the national airline.
"How can Arshad Malik make such appointments when he himself is appointed on deputation?" questioned the top judge.
During the hearing today, Justice Sajjad Ali Shah, who was part of the bench hearing the case, said: "We want to see if the advertisement of PIA CEO's post was designed with Arshad Malik in mind as he does not have the pre-requisite qualification, education or the expertise required for the job."
Justice Shah also raised concerns over reports that a bid worth Rs70 million was awarded to an air commodore and said that the "fares of PIA had increased by 100 per cent" since Malik's appointment.
"You are running the national airline's affairs like those of a family business […] How can you manage PIA when you failed Shaheen Airways miserably?" he remarked.

This is the question mark on courts. In my opinion, they are leaving behind the scope, the boundaries of their own institution for which previously armed institutions blamed for. Is this not a new mess coming up next?Sindh High Court and Supreme court know about Airline business, when did they become experts themselves.
